Terms & Conditions

 

By placing an order on this website, you acknowledge and agree to the following terms and conditions. These terms cover all products and services offered: Print-on-Demand (POD), Original Artworks, and Custom Commissioned Projects.

1. General Pricing and Taxes

  • Pricing: Prices include VAT (where applicable) but do not include local customs duties or import taxes. Shipping costs for shop items are calculated at checkout.

  • Import Duties: Your local customs office may charge additional import duties, VAT, or handling fees. These charges are the sole responsibility of the buyer.

  • Refusal of Delivery: If a package is returned because the customer refuses to pay local customs fees, no refund will be issued.

2. Print-on-Demand (POD) Products (Fulfillment by Prodigi)

  • Fulfillment: All POD orders are fulfilled and shipped through my partner, Prodigi.

  • Production: : Each item is made-to-order. Once an order enters production (typically within 24 hours), it cannot be modified or cancelled.

  • Returns & Refunds: In accordance with EU Law (Article 16(c) of the Directive 2011/83/EU), goods made to the consumer’s specifications are exempt from the 14-day right of withdrawal. POD products cannot be returned or exchanged unless they are defective.

  • Damaged Items: If a product arrives damaged, please contact gizemodabasiart@gmail.com within 72 hours of delivery with clear photos of the item and the original packaging to arrange a replacement.

 

3. Original Artworks (Ready-to-Ship)

  • Shipping: Original paintings are shipped directly from the artist’s studio in the Netherlands. Professional art insurance is included in the shipping fee.

  • Right of Withdrawal (EU Only): : EU customers have the right to withdraw from the purchase of ready-made original artworks within 14 days of delivery.

  • Return Conditions: The buyer is responsible for return shipping costs and must use a tracked/insured service. A full refund (excluding original shipping) will be processed only after the artwork is received and inspected. If the artwork is returned damaged due to insufficient packaging, a deduction will be made for the loss of value.

4. Custom Commission Orders (Bespoke Art)

  • Deposit: A 50% non-refundable deposit is required to secure the artist’s schedule and materials. Work begins only after the deposit has cleared.

  • Exemption from Returns: Custom-made and personalized artworks are strictly exempt from the 14-day return right once production has commenced.

  • Timeline: Typically 2 weeks to 2 months from the date of deposit.

  • Revision Policy: The client is entitled to only one (1) revision, subject to an additional service fee which will be added to the final invoice.

  • Final Payment: : The remaining 50% balance, plus any additional fees (framing, final shipping, or revision), must be paid in full before the artwork is dispatched.

  • Framing: : Bespoke framing is a non-refundable service once the materials have been ordered or the frame crafted.

  • Shipping: : Fees are calculated upon completion and added to the final invoice.

  • Agreement: By paying the initial deposit, the client acknowledges and accepts these commission terms in full.

 

5. Intellectual Property and Copyright

  • Artist Ownership: The copyright to all artworks (including custom commissions) remains exclusively with the artist.

  • Usage Rights: Purchase of an artwork (original or print) does not grant the buyer any commercial reproduction or distribution rights unless explicitly agreed upon in writing.

  • Promotion: The artist reserves the right to display images of all works (including commissions) in portfolios, social media, and promotional materials.

Your personal data is processed by Gizem Odabaşı Art, based in the Netherlands. As the data controller, I am committed to ensuring that your privacy is protected and your data is handled transparently. For any inquiries regarding your personal information, please contact:

I collect only the minimum information necessary to provide you with my artworks and services:

  • Identity & Contact Data: Name, email, shipping/billing address, and phone number.

  • Transaction Data: History of purchased original artworks, prints, or custom commission requests.

  • Payment Information: Payments are processed securely via Wix Payments, or iDEAL. I do not store your credit card or bank details on my server; these are handled entirely by regulated third-party payment providers.

3. Purpose of Data Processing (GDPR / AVG Compliance)

Your information is used strictly for the following purposes:

  • Order Fulfillment: To process and deliver your orders and manage custom commission workflows.

  • Legal Obligations: To comply with Dutch Tax Law (Belastingdienst), which requires business records (invoices) containing personal data to be retained for a statutory period of 7 years.

  • Communication: To provide updates regarding your orders or respond to your technical inquiries.

  • Anti-Spam Policy: I do not sell, rent, or trade your personal data to third parties for marketing or any other purposes.

4. Third-Party Service Providers

To operate this shop effectively, I share limited data with trusted service providers:

  • Wix.com: For website hosting, secure database management, and business operations.

  • Prodigi Group: For the manufacturing and global fulfillment of your print-on-demand orders.

  • Shipping Partners: PostNL, DHL, or other couriers to ensure the physical delivery of your goods.

  • Analytics: Wix Analytics (and Google Analytics where applicable) to understand site traffic and improve your browsing experience.

 

5. Cookies and Tracking Technologies

This website uses cookies to enhance functionality and analyze traffic. You can manage your preferences through the Cookie Consent Banner (powered by Usercentrics) or via your browser settings. Essential cookies (e.g., those required for the shopping cart) cannot be opted out of as they are necessary for the site to function.

6. Data Retention

Personal data is retained only for as long as necessary to fulfill the purposes outlined in this policy. Please note that under Dutch legal obligations, I must store invoices and related transaction data for 7 years for tax auditing purposes.

7. Your Rights Under GDPR

Under the General Data Protection Regulation (GDPR), you have the following rights:

  • Right of Access & Correction: You may request a copy of your data or ask for corrections to inaccurate information.

  • Right to Erasure ("Right to be Forgotten"): You can request the permanent deletion of your personal data, excluding information I am legally mandated to keep for tax purposes.

  • Right to Object: You can object to the processing of your data for specific purposes at any time.

Return & Refund Policy

At Gizem Odabaşı Art, I strive to ensure the highest quality for every piece. Because my collection includes both made-to-order prints and unique original creations, different return policies apply as outlined below

1. Print-on-Demand (POD) Products (Fulfillment by Prodigi)

In accordance with EU Consumer Law (Directive 2011/83/EU, Article 16c), goods made to the consumer’s specifications or clearly personalized are exempt from the 14-day right of withdrawal.

  • Eligible Cases for Replacement: If the product arrives damaged, is defective, or is the wrong item, I will provide a free replacement.

  • Procedure: Please email gizemodabasiart@gmail.com within 72 hours of delivery. Include your order number and clear photos of the damaged item and the original packaging.

  • Cancellations: Once an order enters the production phase (typically within 24 hours), it can no longer be modified or cancelled.

  • Customer Errors: : Replacements or re-shipping due to incorrect/incomplete addresses provided by the customer will be at the customer’s expense.

  • Lost Orders: If a package is confirmed lost by the carrier, a replacement will be issued in accordance with our production partner's (Prodigi) policies.

 

2. Original Artworks (Ready-to-Ship)

  • Right of Withdrawal (EU Law): For ready-made original artworks, EU customers have the right to request a return within 14 days of delivery.

  • Conditions: The artwork must be returned in its original, pristine condition. If the item is returned damaged or altered, the buyer is responsible for any loss in value, which will be deducted from the refund.

  •  Return Logistics: : The buyer is responsible for all return shipping and professional art insurance costs. The refund (excluding original shipping costs) will be processed only after the artwork is received and inspected at the studio.

 

3. Custom Commission Orders (Bespoke Artwork)

  • Non-Refundable Deposit: The initial 50% deposit is strictly non-refundable as it secures the artist’s time and covers initial material costs.

  • Final Sale: Once a custom piece is approved by the client and the final balance is paid, the sale is final. Personalized commissions are exempt from returns or refunds.

  • Transit Damage: If a custom artwork arrives damaged, please contact me immediately with photographic evidence of the packaging and the piece to initiate an insurance claim or discuss restoration options.

FAQ (Frequently Asked Questions)

1. Do you ship worldwide?

Yes! I ship to most countries worldwide.

  • The Netherlands: Shipping is €4.95 (Free for orders over €50).

  • International (EU, USA, UK, Canada): Standard shipping starts at €9.90.

  • Original Artworks & Custom Commissions: Shipping for these items is calculated separately based on size, weight, and destination to ensure safe delivery.

 

2. How long will my order take to arrive?

Since most products are made-to-order (POD), please allow 2–3 business days for production.

  • Europe: 5–10 business days.

  • USA & Canada: 7–15 business days.

  • Rest of the World: 10–20 business days.

  • Please note: Note: Custom original paintings have a longer creative timeline, typically ranging from 2 weeks to 2 months depending on the complexity and drying time.

 

3. Will I have to pay customs fees?

For orders outside the European Union, the buyer is responsible for any import duties, VAT, or handling fees charged by their local government. As these vary by country, I recommend checking with your local customs office before placing an order.

4. What if my order arrives damaged?

Don't worry! If your print or artwork arrives damaged, please email me at gizemodabasiart@gmail.com within 72 hours of delivery. Please include your order number and clear photos of both the damaged item and the original packaging so I can arrange a replacement for you as soon as possible.

 

5. How does the Custom Commission process work?

  • Concept: Once we agree on the vision and timeline, a 50% non-refundable deposit is required to secure your spot in my studio schedule.

  • Creation: Work begins once the deposit clears. I will keep you updated on the progress of your bespoke piece.

  • Completion: After the painting is finished, the remaining 50% balance (plus any framing or final shipping fees) is due before the artwork is dispatched to its new home.

 

6. Can I request a revision on a Custom Order?

To maintain a focused and professional creative workflow, I offer one (1) revision phase per project. Please note that revisions are subject to an additional service fee, which will be added to your final invoice. All revision requests must be finalized before the final balance is paid.

I am delighted to share my art with collectors worldwide. Please take a moment to review our international shipping policy:

  • Shipping Costs: Due to current global maritime and logistical challenges, international shipping rates are subject to fluctuations by carrier providers. The most up-to-date shipping cost for your order will be automatically calculated at checkout based on your delivery address.

  • Customs & Import Taxes: For orders shipped outside of the Netherlands, additional customs duties, taxes, or brokerage fees may apply depending on the destination country’s regulations. Please note that these local charges are the sole responsibility of the buyer. I recommend checking your local customs guidelines before placing an order to stay informed about potential costs.
